Terms of Service

GENERAL TOS
- All prices are in USD.
- All prices and completion dates vary depending on complexity of design and number of revisions.
- For all commissions, please provide character reference images.
- Payment plans are available for commissions totalling more than $1000 USD.

USER AGREEMENT
By commissioning me, you agree to have read and accepted my TOS.
All commissions are digital goods; you will never receive any physical items.
The digital goods will be sent to you via a Google Docs link to download the commission.

PAYMENT
All payments are made via Paypal invoices.
Do not send any money without first receiving the appropriate invoice.All payments must be made prior to starting the commission.
Either 50% or 100% must be paid upfront unless we agreed upon a payment plan.
Payment plans can be discussed only for commissions totalling more than $1000 USD.

REFUNDS
Partial refunds will only be given if I am unable to finish the commission
for whatever reason or at the client's request.If you choose to cancel a commission, a partial refund will be given
based on the amount of work done at the time of the request.Additionally, you will not receive a partially done commission
if it is cancelled, only the fully finished commission will be sent to you.Refund amounts will be determined under the following circumstances:
- Full Refund - if requested before the commission has been started
- 80% Refund - if requested after a sketch has been finished
- 50% Refund - if requested after the lineart has been finished
- 20% Refund - if requested after the coloring has been finished
- No Refund - if requested after the shading has been finished

REVISIONS
Revisions are accepted as long as the request is reasonable. Requests must be made during the check-in times, such as during the sketch, line art, coloring, and shading phases. If the client requests revisions or changes after completing the commission or near completion, a revision fee will need to be discussed.

COPYRIGHT & CREDITING
The client is responsible for ensuring that they hold the rights of ownership to their characters.
The client should not use any stolen characters or designs.-- Commissions may be refused if this condition is not respected --I reserve the right to post my work and wips on social media with credits to the client.
If the client posts my work publicly, they are responsible for crediting me and linking back to my twitter as the artist or live2d artist in their post or twitch bio.

NON-DISCLOSURE AGREEMENT (NDA)
If the client instead wishes to remain anonymous during the commission process, they must pay an additional NDA fee of $15. This agreement only ensures that I keep the confidentiality of the client until they are fully comfortable with the commission going public. I will not post anything about the commission until a condition is discussed and agreed upon.The conditions included are:
- No publicity until the work is fully completed
- No publicity until the client has made their own posts about the commission
- No publicity until the client has given me permission to make posts
- No publicity until the client has had their debut (for vtuber/pngtuber commissions)NOTE: If the client posts the commission online, they still hold the responsibility of
crediting and linking my Twitter in the bio, even after paying the NDA fee.

COMMERCIAL USAGE
All Live2D and PNGTuber commissions come with commercial licenses.
A commercial license allows use on streaming services such as youtube, twitch, etc.
It can be purchased for USD.My art illustrations of any form are not allowed to be used to make a profit, unless a business agreement is made between both parties.
With having a commercial license, I still retain all rights to my work to post on social media.
Additionally, all Clients will still have to credit back to my social media for any work used.
